TIMING CHANGES

Have you been trying to untangle the web of timelines for disclosing?

Will the timing changes impact when my real estate transaction can close?
Consummation is the day the borrower becomes legally obligated under the loan, which would be the date of signing, even if the loan has a rescission period. It is important to note the definition of consummation can be different than the closing date as defined in the purchase agreement where the buyer becomes contractually obligated to a seller on a real estate transaction.

Insuring Living Trusts- Team Title Guy

In the world of busy probate courts and a desire for privacy, the living trust has become a common manner of holding title to real property. The following may help you understand a few of the requirements of the title insurance industry if title to property is conveyed to the trustee of a living trust.
What is a trust?
A trust is an agreement between a trustor and trustee for the trustee to hold title to and administer designated assets of the trustor for the use and benefit of one or more beneficiaries.

Can a trust itself acquire and convey interests in real property?
No. The living trust is an arrangement between a trustee and a trustor. Only the trustee, on behalf of the trust, may own and convey any interest in real property. The trustee may only exercise the powers granted in the trust.
If there is more than one trustee, can just one join?
Maybe. The trust must specifically provide for less than all to sign.
Who can be trustee?
Any individual not under a legal disability or a corporation that has qualified to do a trust business in the state of California.

Wow… As the year blows past us, don’t blink.. Life has a tendency of throwing us curve balls and definitely keeping us on our feet! On behalf of Danielle and I, THANK YOU! The month of April was probably one of the hardest months we have eve endured as a family and as a couple. Losing Charlie was incredibly challenging and I am sure we will face struggles for months and years to come. However, through all of this, we have witnessed many amazing things as well! We witness so much LOVE, that we were overwhelmed! It truly felt like the hand of God was upon us, and this indescribable peace took over us. It was truly incredible to feel His presence with us and neither Danielle nor I could ever imagine going through this without our Faith! Every prayer was and is appreciated, and in case you wondered if it works, the answer is YES. The outcome is NOT what we desired, but there are so many stories and examples of how he was working in and around Charlie! Danielle and I are grateful for so many wishes and we THANK YOU! Know that He loves you and wants a relationship with each of us! Lean on Him in times of struggle and success! Real Estate Withholdings! Do you know. TTG

WHEN DID WITHHOLDING START FOR CALIFORNIA RESIDENTS?
The withholding law applies to dispositions of California real estate by both residents and non-residents which close on and after January 1, 2003. Previously, withholding was only required of non-resident sellers.
Why was this withholding law enacted?
As part of attempting to balance the state budget, this withholding provision was added to legislation on the last day of the legislative session in 2002. It was estimated to accelerate collection of $285 million in additional state revenue.
Who is responsible for withholding?
The law requires the buyer (called the transferee) to withhold from what would otherwise be paid to the seller.
